DMCA Policy

1. Overview

Marine Diagnostic Tools LLC ("MDT") respects the intellectual property rights of others and expects users of the MDT Learning platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), MDT will respond promptly to claims of copyright infringement committed using the MDT Learning platform.

3. Filing a DMCA Takedown Notice

If you believe that content available on or through the MDT Learning platform infringes your copyright, you may submit a written notification to our designated agent containing the following information required by 17 U.S.C. § 512(c)(3):

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: Identification of the material that you claim is infringing and that you request to be removed or have access disabled, with information reasonably sufficient to permit MDT to locate the material (e.g., URL, course name, specific page or section).
3. Your contact information: Your name, mailing address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please consider whether the material at issue constitutes fair use before filing a notice.

4. Counter-Notification

If you believe that material you posted on the platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated agent containing:

1. Identification of the material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
2. Your contact information: Your name, mailing address, telephone number, and email address.
3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, the federal district court for the District of South Carolina), and that you will accept service of process from the person who provided the original notification or an agent of such person.
4. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, MDT will forward it to the original complainant and restore the removed material within 10 to 14 business days, unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity.

5. Repeat Infringers

MDT has adopted and implements a policy of terminating, in appropriate circumstances and at MDT's sole discretion, the accounts of users who are repeat infringers of the copyrights of others. MDT may also, at its sole discretion, limit access to the platform or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.

6. Modifications

MDT reserves the right to modify this DMCA Policy at any time. Any changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the platform after any modification constitutes acceptance of the updated policy.
